La Touche Musicale offers a personalized subscription service that allows our users to access royalty-free music in midi format, import their own music in midi format and learn it on the piano directly from computers and other connected devices (“La Touche Musicale compatible devices”).
1.1. Your subscription to La Touche Musicale continues until it is cancelled. To use the La Touche Musicale service, you must have Internet access and a device that is compatible with La Touche Musicale, and you must provide us with one or more Payment Methods. Payment Method” means a current, valid, accepted payment method that may be updated from time to time and may include payment through your account with a third party. Unless you terminate your subscription prior to your billing date, you authorize us to bill you for the subscription fees for the next billing cycle via your Payment Method (see “Termination” below).
1.2. We may offer various subscription packages, including special promotional packages or subscriptions offered by third parties in connection with the provision of their own products and services. Some subscription packages may have different terms and restrictions, which you will be informed of at the time of registration or in other communications made available to you. You can find the specific details of your La Touche Musicale subscription by visiting our website and clicking on the “My subscription” link available at the top of the La Touche Musicale web application pages, under your profile.
2.1. Your subscription to La Touche Musicale can start with a free trial. The duration of the free trial period is specified during registration, and is intended to allow new members and some old members to try the service.
2.2. La Touche Musicale reserves the right, in its sole discretion, to determine your eligibility for a free trial and to limit it and its duration to prevent abuse of the free trial. We reserve the right to revoke the free trial and suspend your account if we determine that you are not eligible. We may use information such as the device ID, Payment Method or account email address used with an existing or recent La Touche Musicale subscription to determine eligibility. Restrictions may apply when combined with other offers.
2.3. We will charge the subscription fee for the next billing cycle via your Payment Method at the end of the free trial period, unless you terminate your subscription before the end of the free trial period. To view your subscription fees and the end date of your free trial period, please access our website and click on the “My Subscription” link located at the top of our website pages under the “My Account” section.
2.4. La Touche Musicale may not grant a free trial period at its sole discretion in specific cases such as partnership, promotional and exceptional offers, launch offers, or any other specific case.
3.1. Billing cycle. Subscription fees for the La Touche Musicale service will be billed via your Payment Method on the specific billing date indicated on your “My Subscription” page located in the “My Account” section. The length of your billing cycle will depend on the type of subscription you choose when you sign up for the service. In some cases, your billing date may change, for example, if your Payment Method did not work or if your paid subscription started on a day that is not in a given month. Please log in to our website and click on the “My Subscription” link under “My Account” to find out when your next billing will be.
3.2 Payment Methods. To use the La Touche Musicale service, you must provide us with one or more Means of Payment. You authorize us to debit your account via any Payment Method associated with your account in the event that your primary Payment Method is declined or no longer available to us for payment of your subscription fees. You are responsible for any amount not collected. If a payment fails to clear due to card expiration, insufficient balance or for any other reason, and you do not terminate your account, we may suspend your access to our service until we have successfully debited your account via a valid Payment Method. For some Payment Methods, the Provider may charge you certain fees, such as fees on international transactions or other fees related to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Please contact your Payment Method provider for more information.
3.3 Updating Your Means of Payment. You may update your Means of Payment by visiting the “Means of Payment” page located under the “My Account” heading. We may also update your Means of Payment with information provided by payment service providers. After any update, you authorize us to continue to debit your account via the applicable Payment Method(s).
3.4. Termination. You may terminate your La Touche Musicale subscription at any time and you will continue to have access to the Service until the end of your billing period. Payments are non-refundable and we do not issue refunds or credits for partial usage periods, or for any unused La Touche Musicale content. To cancel your subscription, go to the “My subscription” page, click on the “Cancel” link and then click on “Yes” to validate your cancellation. If you cancel your subscription, your account will be automatically closed at the end of your current billing period. If you signed up for La Touche Musicale using an account you have with a third party as your Payment Method and you wish to terminate your La Touche Musicale subscription, you may need to do so with that third party, for example, by reviewing your account with that third party and disabling auto-renewal or unsubscribing from the La Touche Musicale service through that third party. You can also view your billing information for your La Touche Musicale subscription by visiting your account with the appropriate third party.
3.5. Changes in Price and Subscriptions. We may change our subscriptions and the price of our service from time to time. However, any changes to pricing or your subscription are only applicable to the billing cycles following notification of such changes.
4.1. You must be 18 years of age, or have reached the legal age of majority in your province, territory or country, to subscribe to the La Touche Musicale service. Minors may use the service only under adult supervision.
4.2. The La Touche Musicale service, as well as any content used through the service, is for personal, non-commercial use only and is not to be shared with anyone outside your household. During the term of your subscription, we grant you a limited, non-exclusive, non-transferable right to access the La Touche Musicale service and use the La Touche Musicale content. Except for the foregoing, no right, title or interest is granted to you. You agree not to use the service for public viewing.
4.3. You may only use La Touche Musicale content in countries where we offer our service and where we have the relevant licenses. The available content may vary by geographic area and may be changed at any time.
4.4. La Touche Musicale service, including the content of the library, is updated regularly. We also regularly test various aspects of our service, including our website, user interfaces, promotional offers, and availability of La Touche Musicale content.
4.6. The quality and performance of La Touche Musicale display and content may vary from device to device, and may be affected by a variety of factors, including your location, available bandwidth and/or the speed of your Internet connection. You are responsible for the cost of the Internet connection. Please contact your Internet Service Provider to find out about any charges for Internet data usage. The amount of time it takes to use La Touche Musicale content varies depending on several factors, including your location, the bandwidth available at the time you use the content, the content you choose, and the configuration of your La Touche Musicale-enabled device.
4.7. La Touche Musicale software is designed by or for La Touche Musicale and allows the use of La Touche Musicale content and external content via devices compatible with La Touche Musicale. This software may vary depending on the device and media used; functionality and features may also vary depending on the device. By using our service, you acknowledge that it may require the use of third party software subject to the license terms of those third parties. You agree to automatically receive updated versions of the La Touche Musicale software or third-party software associated with the Service.
The user who created the La Touche Musicale account and is charged a subscription fee via the chosen Payment Method (the “Account Holder”) has access to and control over the La Touche Musicale account and the La Touche Musicale enabled devices used to access our service. This user is responsible for any activity that occurs through their La Touche Musicale account. In order to maintain control of the account and prevent anyone else from accessing the account (including accessing the account’s play history information), the Account Holder must maintain control of La Touche Musicale-enabled devices used to access the service and must not disclose the password or Payment Method details associated with the account to anyone. You are responsible for updating and maintaining accurate information about your account. We may terminate or suspend your account to protect you, La Touche Musicale or its partners from identity theft or other fraudulent activity.
6.1. Applicable law. These General Terms and Conditions of Sale are governed by and construed in accordance with the laws of France. These Terms and Conditions of Sale do not limit the consumer protection provisions that you may have under the laws of your country of residence.
6.2. Unsolicited Content. La Touche Musicale does not accept any unsolicited content or ideas regarding La Touche Musicale content, and is not responsible for any similarities between its content or programming and content or ideas transmitted to it.
