At La Touche Musicale, we are committed to protecting your privacy and we want you to know how we treat your personal data.

We’ve updated the Musical Touch service, which includes new settings that allow you to better control how The Musical Touch can use and share your personal data.

Alongside these new settings, we’ve also updated our Data Protection Policy to provide you with more accurate and transparent information about how The Musical Touch – in its capacity as processing manager – collects, uses, shares, retains and protects your personal data.

Personal data we collect

By “personal data” we mean any data that allows The Musical Touch to identify you directly or indirectly.

Your personal data can either be provided directly by yourself, or indirectly provided by third parties (for example, when you subscribe to the Musical Touch service via a telecommunications operator), or collected directly by us when you use the Musical Touch service. When we ask you to provide your personal data, we indicate which data are required to be collected. Thank you for providing us with complete and accurate data. Providing us with incomplete and inaccurate data may prevent us from providing you with the Musical Touch service.

Why we use your personal data

We mainly use your personal data to allow you to take advantage of the Musicale Touch service, but also to fulfill our legal or regulatory obligations. In all cases, we do not make any decisions based exclusively on automated processing, including profiling, producing legal effects affecting you or significantly affecting you in a similar way.

To deliver the Service The Musical Touch

We use your account data, subscription data, usage data and technical data to enable you to take advantage of the Musical Touch service, including the following features:

  • Learning the titles of the music catalogue;
  • Add titles to your favorites;
  • View your game performance on each of the titles in your favorites;
  • Resuming music at the place where you stopped during your last session.

This use of your personal data is necessary to deliver the Service La Touche Musicale, in accordance with the contract that binds us to you.

 

To improve, secure and monitor the La Touche Musicale service

We use your account data, subscription data, usage data and technical data for the following purposes:

  • Improved existing features of The Musical Touch service and its overall performance;
  • Development of new features and services;
  • Continuously ensure the security, confidentiality, integrity, availability and resilience of the Musical Touch service;
  • Measurement and analysis of the audience and use of the Musical Touch service.

This use of your personal data is necessary to enable us to realize our legitimate interest in offering the best possible Musical Touch service to our users.

To promote the Service La Touche Musicale

We use your account data, subscription data, usage data, technical data and participation data for the following purposes:

  • Give you information about the La Touche Musicale service and its features, as well as our paid packages and promotional offers;
  • Give you personalized offers.
  • Allow you to participate in events and contests we organize, and give you the chance to win subscriptions and other prizes;
  • Allow you to participate in satisfaction surveys and give us your opinion on the service La Touche Musicale.

This use of your personal data is necessary to enable us to carry out direct marketing actions and improve the Musical Touch service, which is in the legitimate interest of The Musical Touch.

 

To run ads from third-party advertisers (users of the Free Musical Touch service only)

We use your account data, subscription data, usage data and technical data to show you ads for partner products and services.

These ads can be:

  • Communicated by email or notification: We do not advertise for partner products and services by email or notification until you have consented.

To manage your customer service requests

We use your account data, subscription data, usage data, technical data and query data to manage your customer service requests, for example:

  • When you contact our Customer Service for a request for technical or functional assistance;
  • When you want to exercise the rights you hold over your personal data.

This use of your personal data is necessary to enable us to comply with our obligations arising from the contract that binds us to you, or when it comes to your rights, the laws and regulations on the protection of personal data to which The Musical Touch is subject.

 

To manage your payments (paying users only)

We use your account data, subscription data, usage data and technical data for the following purposes:

  • Processing your payment
  • Accounting and tax obligations;
  • Fight fraud to detect and prevent fraudulent payments or fraudulent uses of the Musicale Touch service.

This use of your personal data is necessary to allow us to process your payment, in accordance with the contract that binds us to you, to comply with the accounting and tax regulations to which La Touche Musicale is subject, as well as to fight fraud, which is in the legitimate interest of La Touche Musicale.

 

How we share your personal data

We share your personal data with the following recipient categories:

Please note that some of these recipients are located in countries outside the European Union/European Economic Area, and whose regulations do not provide a level of personal data protection equivalent to that provided by the European Parliament and Council Regulation 2016/679 on the protection of individuals with respect to the processing of personal data (RGPD).

Most of these recipients outside the European Union/European Economic Area are in the United States of America and have certified that they comply with the EU-U.S. Privacy Shield agreement, designed by the U.S. Department of Commerce and the European Commission to provide businesses on both sides of the Atlantic with a mechanism for compliance with personal data protection requirements when transferred from the European Union and Switzerland to the United States, in order to support transatlantic trade.

For recipients who are not located in the European Union/European Economic Area, or that would not be located in a country with a level of data protection considered adequate (Article 45 of the RGPD), or which would not comply with the EU-U.S. Privacy Shield agreement, we would take all necessary measures to ensure that they provide appropriate safeguards, such as the implementation of the standard contractual clauses defined by the European Commission (Article 46.2 of the RGPD).

When you use the Musical Touch service, you have the option of:

  • Connect third-party devices to your user account, such as pianos, digital keyboards, synthesizers or connected speakers, smartphone, tablet and computer;

You can manage your profile in your settings.

 

How long we keep your personal data

 

We keep your personal data for a period of no longer than necessary for the purposes for which we collect and use it.

How we protect your personal data

We implement measures to protect your personal data from unauthorized access, use and disclosure, including:

  • We implement and maintain advanced technical measures to ensure that your personal data is stored and used confidentially and securely;
  • We restrict and limit access to your personal data, and we monitor who accesses, uses and transfers your personal data;
  • Employees with access to your personal data are required to comply with our internal privacy policy and confidentiality obligations;
  • The partners and service providers with whom we share your personal data are required to comply with any applicable privacy and data protection obligations.

How you can exercise your rights

In accordance with applicable data protection laws and regulations, you have the right to:

  • Access, correct and delete your personal data;
  • Restrict and oppose their treatment;
  • Tell us that you don’t want to receive any business information;

  • To the extent that the processing of your personal data is based on your consent, withdraw that consent, without affecting the legality of the processing of your data before it is withdrawn;
  • In some countries, define your wishes for the retention, erasure and disclosure of your personal data after your death.

In case you are not fully satisfied with our response, you have the option to make a complaint to the relevant data protection authority.

 

Association at the GAR and Ministry of National Education

The ministry protects personal data for access to resources produced by students and teachers.

The GAR is a data processing processing of the Ministry of National Education. THE GAR data processing is the sole responsibility of the Minister responsible for national education. The heads of schools therefore do not have to register this treatment as they do not determine the purposes or means of treatment.

Changes to our Data Protection Policy
